Terms of Service

1. Acceptance of Terms

By accessing or using the autoSQD platform ("Service"), operated by autoSQD ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of Service

autoSQD is a subscription-based software platform for automotive enthusiasts, vehicle builders, restorers, and customizers. The Service provides tools for project management, garage organization, maintenance tracking, build documentation, AI-assisted guidance, image uploads, and community interaction related to automotive projects.

3. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service.

By using the Service, you confirm that:

• you have the legal capacity to enter into these Terms;
• the information you provide is accurate and complete; and
• you will comply with all applicable laws and regulations.

4. Account Registration

To access certain features, you must create an account.

You agree to:

• provide accurate and current information;
• maintain the confidentiality of your login credentials;
• promptly notify us of unauthorized access to your account; and
• accept responsibility for activities occurring under your account.

We reserve the right to suspend or terminate accounts containing false or misleading information.

5. Subscription and Billing

autoSQD offers both free and paid subscription plans.

By subscribing to a paid plan:

• you authorize recurring billing using your selected payment method;
• subscription fees are billed in advance on a recurring basis;
• subscriptions automatically renew unless cancelled before renewal;
• you may cancel at any time, with cancellation taking effect at the end of the current billing period; and
• we may change pricing with reasonable prior notice.

Payments are processed by third-party payment providers. We do not store full payment card details on our systems.

6. AI Features and Credits

Certain features of the Service use AI-powered functionality that may consume usage credits.

Credits:

• are allocated according to your subscription plan;
• may reset periodically;
• are non-transferable;
• have no cash value; and
• may not be exchanged or redeemed for currency.

We reserve the right to modify AI functionality, credit allocations, and usage limits.

7. User Content

You retain ownership of content you upload or submit to the Service, including images, text, project information, and vehicle data ("User Content").

By submitting User Content, you grant autoSQD a worldwide, non-exclusive, royalty-free license to host, process, display, reproduce, and distribute such content solely for the purpose of operating, improving, and providing the Service.

You are solely responsible for your User Content and represent that:

• you own or have the necessary rights to submit it;
• it does not violate applicable laws; and
• it does not infringe the rights of third parties.

8. Upload and Content Policy

The Service is intended exclusively for automotive-related projects and activities.

You may not upload or share:

• illegal content;
• sexually explicit or pornographic material;
• content involving minors in any inappropriate or unlawful context;
• violent or abusive material;
• hateful or discriminatory content;
• malware or harmful software;
• content infringing intellectual property rights; or
• unrelated file storage or non-automotive bulk media.

We reserve the right to:

• review uploaded content;
• remove content violating these Terms;
• suspend or terminate accounts; and
• report unlawful activity to relevant authorities where legally required.

9. Acceptable Use

You agree not to:

• use the Service unlawfully;
• interfere with platform security or operations;
• scrape or harvest platform data;
• attempt unauthorized access;
• impersonate others;
• distribute spam or malicious content; or
• misuse AI functionality.

10. Intellectual Property

The Service, including software, branding, design, features, and content provided by autoSQD, is protected by intellectual property laws.

Except as permitted by law, you may not:

• copy;
• modify;
• distribute;
• reverse engineer; or
• commercially exploit any part of the Service without prior written consent.

11. Service Availability

We aim to provide reliable access to the Service but do not guarantee uninterrupted availability.

The Service may occasionally experience:

• maintenance;
• downtime;
• feature changes; or
• interruptions outside our control.

12. Termination

We may suspend or terminate access to the Service at our discretion where:

• these Terms are violated;
• unlawful conduct is suspected; or
• use of the Service creates risk or harm.

You may stop using the Service at any time.

Upon termination, certain data may be deleted in accordance with our Privacy Policy.

13. Limitation of Liability

To the maximum extent permitted by law:

• the Service is provided "as is" and "as available";
• we disclaim all warranties except those that cannot legally be excluded; and
• autoSQD shall not be liable for indirect, incidental, consequential, special, or punitive damages.

Our total liability shall not exceed the amount paid by you to autoSQD during the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless autoSQD from claims, liabilities, damages, losses, and expenses arising from:

• your use of the Service;
• your User Content; or
• your violation of these Terms.

15. Changes to Terms

We may update these Terms periodically.

Material changes may be communicated through the Service or via email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

16. Governing Law

These Terms are governed by the laws of the Netherlands and applicable European Union regulations.

Any disputes shall be subject to the jurisdiction of the competent courts of the Netherlands.
