Terms of Service

1. Acceptance of Terms

By accessing or using the auto[SQD] platform ("Service"), operated by autoSQD ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

auto[SQD] is a car enthusiast social network and garage management platform that allows users to document vehicle builds, track maintenance and jobs, manage budgets, and connect with the automotive community.

3. Account Registration

To access certain features, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

4. Subscription and Billing

auto[SQD] offers both free and paid subscription tiers. By subscribing to a paid plan:

• You authorize us to charge your chosen payment method on a recurring basis
• Subscription fees are billed in advance on a monthly basis
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period
• We reserve the right to change pricing with 30 days' prior notice

All payments are processed securely through our third-party payment provider, Lemon Squeezy. Your payment information is handled in accordance with their terms and privacy policy.

5. AI Credits

Certain features of the Service use AI-powered functionality that consumes credits. AI credits are allocated monthly based on your subscription tier, do not roll over between billing periods, and are non-transferable.

6. User Content

You retain ownership of all content you submit to auto[SQD], including vehicle photos, build descriptions, and project data ("User Content"). By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content solely for the purpose of operating and improving the Service.

You are solely responsible for your User Content and represent that you have the right to share it. We reserve the right to remove any content that violates these terms.

7. Image Upload Policy

auto[SQD] provides image upload functionality exclusively for documenting your vehicle projects, builds, and related automotive content. By uploading images to the Service, you agree to the following:

• Project-related content only: All uploaded images must be directly related to your vehicle projects, builds, parts, tools, maintenance, or automotive activities. The Service is not a personal file storage platform.
• Prohibited content: You must not upload any images containing explicit, adult, sexually suggestive, or pornographic content; content depicting violence, abuse, or harm to persons or animals; content that is illegal under applicable law, including but not limited to child sexual abuse material (CSAM); content that infringes on the intellectual property rights of others; or any other content unrelated to the automotive purpose of the Service.
• Monitoring and enforcement: We reserve the right to review uploaded content, whether through manual review, automated detection systems, or a combination of both. We may remove any content that violates this policy without prior notice.
• Immediate account termination: If we detect or are made aware of any illegal content, explicit adult content, or content that otherwise seriously violates this policy, we reserve the right to immediately and permanently terminate your account without prior warning, and to delete all associated data.
• Referral to law enforcement: In the case of content that is illegal or that we reasonably suspect to be illegal, we will report the matter to the relevant local law enforcement authorities and cooperate fully with any resulting investigation. This includes, but is not limited to, providing account information, upload metadata, IP addresses, and any other information requested by authorities.

By using the upload functionality, you acknowledge and accept this policy. If you are unsure whether content is appropriate, err on the side of caution and do not upload it.

8. Prohibited Use

You agree not to:

• Use the Service for any unlawful purpose
• Upload, share, or distribute any illegal, explicit, or adult content
• Use the Service as a personal file storage platform for non-automotive content
• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Attempt to gain unauthorized access to the Service or its systems
• Use automated means to scrape or extract data from the Service
• Interfere with or disrupt the Service's infrastructure
• Resell or redistribute access to the Service without authorization

9. Intellectual Property

The Service, including its design, features, code, and branding, is owned by autoSQD and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

10. Termination

We may suspend or terminate your account at our discretion if you violate these terms or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. You may request a copy of your data within 30 days of termination.

11. Limitation of Liability

To the maximum extent permitted by law, autoSQD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

12. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of material changes via email or through the Service. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.

13. Governing Law

These terms are governed by and construed in accordance with the laws of the European Union and the applicable national laws of the jurisdiction in which autoSQD is established. Any disputes shall be resolved in the competent courts of that jurisdiction.
